Account Setup:

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. You agree to provide Glasir Host with accurate and complete contact information.

Content:

All services provided by Glasir Host may only be used for lawful purposes. The customer agrees to indemnify and hold harmless Glasir Host from any claims resulting from the use of our services.

Examples of unacceptable material:

* IRC bots
* Proxy scripts
* Warez sites
* Pirated software
* Hate sites
* Hack programs and archives
* Sites promoting illegal activities
* Pornography/adult content
* Any material breaching copyright laws

Glasir Host will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to deactivate and remove any site or content at any time for any reason without refund.

Spam and Unsolicited Commercial Email (UCE):

Glasir Host takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or spam over our network. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice or refund.

Glasir Host reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. Glasir Host also reserves the right to make any such modifications in an emergency at our sole discretion.

Glasir Host reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Glasir Host.

Payment Information:

You agree to supply appropriate payment for the services received from Glasir Host, in advance of the time period during which such services are provided. You agree that until and unless you notify Glasir Host of your desire to cancel any or all services received, those services will be billed on a recurring basis.

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Glasir Host.

Failure to pay any outstanding invoices beyond their due date may result in account termination. Glasir Host reserves the right to charge a late fee where any invoices are not paid on time.

Backups and Data Loss:

Your use of the service is at your sole risk. Glasir Host is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and stored on your account and to maintain all appropriate backup of files and data stored on Glasir Host servers.

The backups maintained by Glasir Host are for emergency data recovery, and no guarantees are made about the integrity or freshness of the backups. Glasir Host reserves the right to charge a client for non-essential access to and recovery of backed up data.

Account Transfer Service:

Our transfer service is provided as a courtesy service, and as such no guarantee of availability is made. The transfer service involves the transfer of data from your previous services provider to your Glasir Host account. The transfer service is provided as a "best effort" service and no guarantees are made about the timeframe of the transfer service or the integrity of any data transferred. By making use of the transfer service you agree to indemnify and hold harmless Glasir Host of any issues that may arise as a result of the transfer service including but not limited to: File and/or database corruption, downtime, bandwidth charges, DNS issues, missing files and/or databases and problems with your previous service provider.

Any bandwidth used during the transfer will count against your monthly bandwidth limit.

It is up to the client to ensure that all data has been transferred correctly before cancelling any services with their previous services provider.

Domain Names:

Glasir Host reserves the right to repossess and auction any domain name that has not been paid for by the client. This provision includes any case where the client has paid for the domain name and then disputed the payment resulting in a chargeback.

Harrasment:

Glasir Host will not tolerate any harrasment or abuse directed towards our staff or other clients. Any abuse will be treated as a breach of the terms of service.

Cancellation and Refunds:

Customers may cancel at any time, but will not be entitled to a pro-rata refund of remaining time left on their services.

Glasir Host reserves the right to cancel the account at any time. Users in breach of our terms and conditions will not be eligible for refund under any circumstances.

In any situation where a moneyback guarantee is offered, only first-time accounts are eligible. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Any charge disputed with your credit card issuer or payment provider resulting in a chargeback that is deemed a valid charge at Glasir Host's sole discretion as outlined in the terms of service may result in an administrative fee of no less than $30 and no more than $100.

Resource Usage:

Users may not initiate the following:

* Use 25% or more of system resources for longer then 90 seconds.
* Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
* Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as an IRCD.
* Run any server side software that interfaces with an IRC (Internet Relay Chat) network. Java applets that are run client side are acceptable.
* Run any BitTorrent related service.
* Run any voice or gaming servers.

Bandwidth Usage:

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation. Additional bandwidth can be purchased or upgraded. Unused transfer in one month cannot be carried over to the next month.

Clients may request that automatic suspension when an account exceeds the allocated bandwidth limit to be turned off if they agree to pay the cost of any additional bandwidth used, as shown below:

Bandwidth purchased in advance: $0.50 per GB (gigabyte) for the first 50GB, and $0.30 for each additional GB.
Bandwidth overages: $1 per GB over the allocated amount.

If you are expecting your account to exceed your allocated bandwidth limit, it is always advisable to contact Glasir Host as soon as possible to make arrangements.

Price Change:

The amount you pay for hosting will never increase from the date of purchase, unless stated otherwise such as a limited time special offer. We reserve the right to change prices listed on Glasir Host, and the right to increase the amount of resources given to plans at any point in time.

Reselling:

It is prohibited to resell hosting or to host sites that do not belong to the account holder free of charge or otherwise from a shared hosting account. Reseller accounts are provided for this purpose.

Indemnification:

Customer agrees that it shall defend, indemnify, save and hold Glasir Host harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Glasir Host, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Glasir Host against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Glasir Host; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Glasir Host's server.

Disclaimer:

Glasir Host will not be responsible for any damages your business may suffer. Glasir Host makes no warranties of any kind, expressed or implied for services we provide. Glasir Host disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Glasir Host and its employees.

Misc:

We reserve the right to refuse service to anyone at any time for any reason.

Changes to the terms of service:

Glasir Host reserves the right to revise its policies at any time without notice. A change in terms takes effect from the moment of the changes being published online. It is your responsibility to check our policies for change, and any continued use of services after a change in terms constitutes an acknowledgement and agreement with the new terms.
